First Sergeant Rape Case Begins on Camp Casey
From the Stars and Stripes:
The trial of a sergeant first class accused of soliciting and raping a female soldier, sexually assaulting another and coercing a third to make a false statement entered its third day Friday.
Sgt. 1st Class Carlos L. Reynolds, acting first sergeant with the 2nd Infantry Division’s 302nd Brigade Support Battalion, pleaded not guilty to all charges. One charge of insubordination was dropped earlier this week. (…)
Prosecutors say Reynolds raped a private after three other junior enlisted soldiers left Spc. Renee Hoist’s barracks room on June 22.
Defense lawyers questioned whether penetration had occurred, citing statements the private made to investigators.
Prosecutors countered that her testimony met the legal standard of rape, which requires at least a slight penetration, they said. She screamed at Reynolds to express lack of consent, they added.
Sounds pretty grim right? Well this is why it is important to presume innocence until proven guilty:
Kincaid said the private’s statements to investigators and defense lawyers were inconsistent, with differences about her clothing and whether she told her mother of the alleged rape.
The private’s former supervisor, Sgt. Shalika Worlds , rated the alleged victim’s trustworthiness as a two on a scale of one to 10.
“She’s a habitual liar, sir. She’s untrustworthy,†Worlds told Kincaid.
“I wouldn’t believe anything she told me unless I had actual proof,†former co-worker Sgt. 1st Class Jeffrey Murphy said.
Soon after the alleged rape, the private received Article 15 nonjudicial punishment for making false official statements and disrespecting a different sergeant, Foxtrot Company commander Capt. Donald Little testified.
It will be interesting to see how this trial turns out, but this just goes to show that rape cases are not always a cut and dry thing. However, even if this NCO is found not guilty, from reading the whole article it does sound like this guy is definitely guilty of some bad judgment. You never go into a female’s room without having a witness with you. If you do that you are opening yourself up to not only accusations like this, but most commonly the rumor mill which can be just as destructive to a unit.Â

The buddy system might have prevented this !
Even Forrest Gump had a buddy!
Two heads are better than one.
Sticks and stones may break your bones,
but words can get you Court Martialed!
The answer is simple. WACs. Solves everyones problems and removes HUGE burdens from the chain of command and both sexes of all ranks. Sorry, not Politically Correct.
The E7 was either not very bright, read stupid, or he was hopeing for an agreement for sex. Either way, he dosn't deserve his rank. Nor does he deserve a rape convictions.
I saw too much of this crap in ALL the Support units I served in.
Females want to serve — Great. Females (working) with males — well lets think about it — somebody is gonna f–k somebody.
As a PFC I watched a female leave a sergeants room, go down stares, get confronted by her AIT boyfriend, burst into tears, cry rape, and end that sergeants career.
That was just my intro to females in the Army. And Oh, don't you dare treat them like you would a male! That is just too damn EQUAL.
Had a female Commander in 1995, Korea. She was on top of the situation, no pun intended. Had a meeting with all the females in the company, told them she knew the game, and wouldn't stand for it in her unit. She got EO complaints from the females, which went no where. She was the exception. Of course there were rumors about her and an E7 also.
Females and Males working together—someones gonna get f–ked.
Something similar happened to a guy I knew once.
He was diddling around with a female E-4–a woman who was not his wife–and eventually he came clean and told her about his marriage, and that he had to cut off their relationship. She was not happy, and immediately went to the authorities accusing him of rape. She even had witnesses testify during the Article 32 investigation to that effect.
Well, during the court martial, all of the prosecution's witnesses were informed of the consequences of perjury by the defense. They immediately broke down and told the court that the accuser had put them up to the false charges. Even the accuser's husband testified that he lied on her behalf, and that there had never been any sort of sexual assault.
The prosecution's case unraveled in record time.
Still, this guy I knew got convicted of Conduct Unbecoming, and was drummed out of the service. It was the only charge that stuck. And of course, nothing happened to the accuser for filing false rape charges.
Hell of a story no?

Marcus, you story isn't the only story like that out there I have heard about. I can remember reading in the S&S about a USFK dependent who was fooling around with a soldier and her parents found out and she claimed rape. Fortunately the soldier was found innocent during the trial but his reputation gets ruined and nothing ever happens to the accusers.
That is why I have always maintained you shouldn't fool around with female soldiers because of the risk of being accused and if you are in a females room for whatever reason have a witness with you.
I have NCO friends that mess with E4 and below females and I preach to him quite often of what could happen to him and what I have seen happen to others
I think I will direct him to this site
