NCO Acquitted of Charges Included Calling Soldier Fat and Touching Her Hair

The NCO in this article was right to take this to a court martial because she was acquitted of all charges:

 A senior noncommissioned officer accused of pointing a pistol at one soldier, calling another fat and improperly touching a third’s hair was acquitted of all related charges at her court-martial Wednesday.
Sgt. 1st Class Jessica Barboza was found not guilty of dereliction of duty, maltreatment and disrespecting an NCO by a panel of nine male officers and senior NCOs. At least four of them had to agree to acquit.
“I’m relieved,” said Barboza, 35, of the 2nd NATO Signal Battalion in Naples, “I’m just grateful to the jury members.”
Criminal charges were brought against Barboza after she declined to accept nonjudicial punishment, following a command investigation into complaints about her more than a year ago.
“You won’t see these crimes on ‘Law & Order,’” prosecutor Capt. Mike Gerrity conceded in his closing argument. “But this is the military. Sergeant 1st Class Barboza failed to put her soldiers’ needs above her own.”
Testimony against her included that of two soldiers who said she’d pointed a 9 mm pistol at one of them during weapons training, which Barboza said wasn’t true. Another soldier said Barboza humiliated her by repeatedly calling her fat, while an African-American staff sergeant said Barboza had touched her hair without permission and then called it “nasty” when rebuked.

You can read the rest at the link, but the NCO basically said that these soldiers were out to get her because she is too gung-ho. She said that in the future she will try to be more sensitive.

USFK Soldier Facing Court Martial On the Run In South Korea

It might help to track this guy down if a picture of what he looked like was available:

A U.S. soldier under military investigation has disappeared from a base near the border with North Korea, a spokesman said Thursday.

The missing soldier is being investigated for a violation of the Uniform Code of Military Justice, said Lt. Col. Richard Hyde, a 2nd Infantry Division spokesman. South Korean police said the soldier had been scheduled to face a court-martial Wednesday, but the military declined to confirm that or provide details about the charges.

The soldier, who is in his 20s, is not wanted for a violent crime, Hyde said.

“We do not believe that he is armed or dangerous,” he said. “He is believed to be in Seoul.”  [Stars & Stripes]

USFK Court Martial Results for March 2016

Here are the USFK court martial results and ROK criminal prosecutions for March 2016.  For whatever reason the PAO did not post the February 2016 results.  Anyway there was a lot of incidents adjudicated in March which included mostly sexual assault and petty larceny cases.  I wonder what all the people convicted of larceny were caught doing?

Results of US Court-Martials for March 2016

On 1 March 2016, at a Special Court-Martial, SGT Eliejaiah I. Belton, Headquarters and Headquarters Battalion, Eighth Army, was found guilty of one specification of abusive sexual contact (Article 120, UCMJ), two specifications of assault consummated by a battery (Article 128), one specification of unlawful entry (Article 134), one specification of adultery (Article 134), one specification of wearing improper uniform (Article 134), four specifications of maltreatment of a subordinate (Article 93), and one specification of violating a lawful general regulation (Article 92). He was sentenced to be reduced to the grade of E-1, to forfeit $687 per month for three months, and to be confined for three months.

On 2 March 2016, at a General Court-Martial, SGT Patrick L. Clark, 6th Ordinance Battalion, Materiel Support Command-Korea, was found guilty of one specification of committing a sexual assault and one specification of committing an abusive sexual contact (Article 120, UCMJ). He was sentenced to be confined for 25 months and to be discharged from the service with a dishonorable discharge.

On 11 March 2016, at a Summary Court-Martial, PVT Richard E. Potter, 6th Battalion, 37th Field Artillery Regiment, 210th Field Artillery Brigade, was found guilty of one specification of assault consummated by battery (Article 128, UCMJ). He was sentenced to forfeiture of $696.00 pay per month for one month and to be restricted for 45 days.

On 12 March 2016, at a Special Court-Martial, SFC Jeffrey L. Cupitt, 1st Signal Brigade, was found guilty of one specification of larceny of government property of a value over $500 (Article 121, UCMJ) and four specifications of false official statement (Article 107). He was sentenced to be confined for four months and to be reprimanded.

On 14 March 2016, at a Special Court-Martial, SGT Maria E. Rosario, 121 Combat Support Hospital, 65th Medical Brigade, was found guilty of two specifications of larceny, each of a value under $500 (Article 121, UCMJ). She was sentenced to be reduced to the grade of E-3, and to be restricted for 60 days.

On 24 March 2016, at a General Court-Martial, SPC Danny J. Jackson, 498th Combat Sustainment Support Battalion, Materiel Support Command-Korea, was found guilty of one specification of sexual assault and one specification of abusive sexual contact (Article 120, UCMJ), one specification of false official statement (Article 107), and two specifications of assault consummated by a battery (Article 128). He was sentenced to be reduced to the grade of E-1, to forfeit all pay and allowances, to be confined for twelve months, and to be discharged from the service with a dishonorable discharge.

On 31 March 2016, at a Special Court-Martial, SGM Terrence S. Ellies, Headquarters and Headquarters Battalion, Eighth Army, was found guilty of one specification of larceny of military property of under $500 (Article 121, UCMJ), and three specifications of false official statement (Article 107). He was sentenced to be reprimanded, to pay a fine of $1,200, and to forfeit $4,644 per month for two months.

On 31 March 2016, at a General Court-Martial, SSG Thomas M. Weekly, 194th Combat Sustainment Support Battalion, 2d Infantry Division Sustainment Brigade, was found guilty of two specifications of assault consummated by a battery (Article 128, UCMJ) and unlawful entry (Article 134). He was sentenced to be reduced to the grade of E-4, and to be confined for 6 months.

Results of ROK Criminal Prosecutions for March 2016

In Busan District Court, on 2 March 2016, SFC Curtis W. Turner, B Co, 532d MI Bn, was convicted of DUI. His adjudged sentence was a 1,000,000 Won fine.

In Suwon District Court, on 23 March 2016, SPC Shanna C. S. McLaurin, HHC, 304th ESB, USAG Humphreys, was convicted of traffic law violations. Her adjudged sentence was a 3,000,000 Won fine.

USFK Court Martial Results for March 2015

Below are the 2015 court martial results posted on the USFK website.  Of interest this month is that a Captain out of the 65th Medical Brigade was convicted of apparently being a drug dealer of prescription medications.  That is something I have never seen a military healthcare provider convicted of.  You can read the rest of the results below:

Results of US Court-Martials for March 2015

On 19 March 2015, at a General Court-Martial, MSG Robela L. Jamison, 602d Aviation ASB, 2CAB, was found guilty of three specifications of assault consummated by battery (Article 128, UCMJ) and one specification of dishonorably failing to pay a debt (Article 134). He was sentenced to be reduced to E-7 and to be confined for 75 days.

On 24 March 2015, at a General Court-Martial, CPT Chung, Ki Young, 65th Medical Brigade, was found guilty of one specification of possession of illegal drugs (Article 112a, UCMJ), one specification of false official statement (Article 107), and eight specifications of soliciting others to distribute unlawfully prescribed drugs (Article 134).  He was sentenced to confinement for two years and to be dismissed from the service.

On 25 March 2015, at a Summary Court-Martial, SFC Paul D. Mitchell, 35th Air Defense Artillery, was found guilty of one specification of assault consummated by a battery (Article 128, UCMJ) and one specification of false official statement (Article 107).  He was reduced to E-6 and sentenced to 30 days restrictions (suspended for 180 days

On 26 March 2015, at a Special Court-Martial empowered to adjudge a Bad-Conduct Discharge, PVT David M. Tompkins, HHBN, 2ID, was found guilty of two specifications of assault consummated by battery (Article 128, UCMJ).  He was sentenced to 4 months of confinement and to be discharged from the service with a Bad-Conduct Discharge.

Results of ROK Criminal Prosecutions for March 2015

In Daegu District Court on 3 March 2015, PFC Shuvon Darden, 229th Signal Company, USAG Daegu, was convicted of Destruction and Damage of Property.  His adjudged sentence was a 500,000 Won fine.

In Daegu District Court on 10 March 2015, TSgt James R. Andrews, 607th MMS, USAG Daegu, was convicted of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Hit and Run Vehicle).  His adjudged sentence was a 5,000,000 Won fine.

In Seoul Central District Court on 13 March 2015, PVT Brian A. Willett, 142d MP Company, USAG Yongsan, was convicted of Infliction of Bodily Injury.  His adjudged sentence was imprisonment for 6 months, unsuspended.

In Uijeongbu District Court on 18 March 2015, SGT Charles D. Krappitz, A Co, 2/9th Infantry, USAG Casey, was convicted of Destruction and Damage of Property.  His adjudged sentence was a 1,000,000 Won fine.

In Uijeongbu District Court on 18 March 2015, 1LT Solomon Choi, HHT, 4/7th Cavalry, USAG Casey, was convicted of DUI and a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury through Dangerous Driving).  His adjudged sentence was a 7,000,000 Won fine.

In Seoul Central District Court on 18 March 2015, SrA Keiyon M. Monroe, 51st DS/SGD. Osan Air Base, was convicted of Infliction of Bodily Injury.  His adjudged sentence was a 1,000,000 Won fine.

In Uijeongbu District Court on 19 March 2015, SGT Devin R. Johnson, 46th Transportation Company, USAG Red Cloud-Stanley, was convicted of DUI.  His adjudged sentence was a 1,000,000 Won fine.

In Uijeongbu District Court on 25 March 2015, PFC Clarence Hall, III., B Btry, 6/37th FA USAG Casey, was convicted of Indecent Act by Compulsion.  His adjudged sentence was a 5,000,000 Won fine and 40 hours of sexual crime prevention class.

Results of Army Courts-Martial for February 2015

On 17 February 2015, at a General Court-Martial, Specialist Nicholas J. Majetich, 94th Military Police Battalion, 501st Sustainment Brigade, was found guilty of one specification of sexual abuse of a child under 16 years of age (Article 120, UCMJ).  He was sentenced to be reduced to E-1, to be confined for 15 months; and to be discharged with a Bad Conduct Discharge.

On 18 February 2015, at a General Court-Martial, Specialist Steven V Dang, 2-1 Air Defense Artillery, 35th Air Defense Artillery Brigade, was found guilty of one specification of possession of child pornography (Article 134, UCMJ).  He was sentence to be confined for 20 months, to be reduced to E-1, and to receive a Bad Conduct Discharge.

On 23 February 2015, at a General Court-Martial, Specialist Joseph A. Warren, 1-15 Field Artillery, 210th Field Artillery Brigade, 2d Infantry Division, was found guilty of one specification of making a false official statement (Article 107, UCMJ), one specification of wrongful use of a controlled substance (Article 112a), one specification of aggravated assault in (Article 128), one specification of assault consummated by battery (Article 128), and one specification of communicating a threat (Article 134).  He was sentenced to be reduced to E-1, to be confined for 17 months, and to receive a Bad-Conduct Discharge.

On 27 February 2015, at a General Court-Martial, PV2 Javier Davis, 618th DENTAC, 65th Medical Brigade, was found guilty of one specification of assault consummated by a battery (Article 128, UCMJ).  He was sentenced to be reprimanded, to be reduced to E-1, to forfeit $1546 per month for two months, to be restricted for 60 days, and to perform hard labor without confinement for 60 days.

In Daegu District Court on 5 February 2015, SGT Liuneta J. Ioane, Jr., HHC, 19th ESC, USAG Daegu, was convicted of Indecent Act by Compulsion.  His adjudged sentence was a 3,000,000 Won fine and ordered to register as sex offender with the local authority.

In Jeonju District Court on 4 February 2015, SSgt Jael X. Laborn, 8th FW (duty w/AFN), Kunsan Air Base, was convicted of traffic law violations including leaving the scene of the accident.  His adjudged sentence was a 5,000,000 Won fine.

In Suwon District Court on 12 February 2015, SFC Darin A. Cox, A Btry, 6/52d ADA, Osan Air Base, was convicted of DUI and a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury Resulting from Dangerous Driving).  His adjudged sentence was a 6,000,000 Won fine.

On 6 January 2015, at a Special Court Martial, Specialist Alvin Cinco, 168th Multifunctional Medical Battalion, 65th Medical Brigade, was found guilty of one specification of Abusive Sexual Contact (Article 120, UCMJ).  The Soldier was sentenced to be reduced to E-1, to perform 30 days of hard labor, and to be restricted for 30 days to the confines of Camp Walker.

On 9 January 2015, at a General Court-Martial, Private (E-2) Joseph Kargbo, 498th Combat Sustainment Battalion, 501st Sustainment Brigade, was found guilty of one specification of disobeying a commissioned officer’s lawful order (Article 90, UCMJ); one specification of sexual assault (Article 120); one specification of false official statement (Article 107); two specifications of assault upon a law officer (Article 128); and one specification of failing to obey a general order (Article 92).  He was sentenced to be reduced to E-1, to forfeit of all pay and allowances, to be confined for 180 days, and to be discharged with a Bad-Conduct Discharge.

On 9 January 2015, at a Summary Court-Martial, Sergeant First Class Steven E. Barnett, 94th Military Police Battalion, 501st Sustainment Brigade, was found guilty of one specification of signing a false document (Article 107); and two specifications of larceny of military property (Article 121).  He was sentenced to be reduced to E-6 and to forfeit $2,914.00 pay per month for one month.

On 15 January 2015 at a Special Court-Martial, Private (E-1) Stefan D. Hughes, 602d ASB, 2CAB, 2ID, was found guilty of one specification of aggravated assault (Article 128, UCMJ); one specification of assault consummated by battery (Article 128); one specification of insubordinate conduct toward a noncommissioned officer (Article 91); one specification of destruction of nonmilitary property (Article 109); two specifications of wrongful appropriation (Article 121); and one specification of disorderly conduct  (Article 134).  He was sentenced to be confined for 140 days, to forfeit $600 pay per month for four months, and to be discharged with a Bad Conduct Discharge.

On 22 January 2015, at a General Court-Martial, Private (E-2) Fernando P. Cabrera, 501st Special Troops Battalion, 501st Sustainment Brigade, was found guilty of two specifications of abusive sexual contact (Article 120, UCMJ) and one specification of indecent visual recording (Article 120c).  He was sentence to be reduced to the grade of E-1, to be confined for 20 months, and to be discharged with a Bad-Conduct Discharge.

On 29 January 2015, at a General Court-Martial, Private (E1) Romel L. Jackson, 1-15th, 210th FA, 2ID, was found guilty of one specification of assault consummated by battery (Article 128, UCMJ) and one specification of aggravated assault (Article 128).  He was sentenced to be confined for 10 months, and to be discharged with a Bad Conduct Discharge.

Bradley, 304th Expeditionary Signal Battalion, 1st Signal Brigade, was found guilty of one specification of dereliction of duty (Article 92, UCMJ), and one specification of disobeying a lawful general regulation (Article 92).  He was sentenced to be reduced to E-1, to forfeit 2/3 pay for one month, and to be confined for 30 days.

On 30 January 2015, at a General Court-Martial, Specialist Denzel C. James, 1-15th, 210th FA, 2ID, was found guilty of three specifications of assault consummated by battery (Article 128, UCMJ).  He was sentenced to be reduced  to E-1, to be confined for seven months , and to receive a Bad Conduct Discharge.

In Uijeongbu  District Court on 5 January 2015, SSG SSG Joshua L. Tverberg, HSC, HHB, 2d Infantry Division, USAG Red Cloud, was convicted of traffic law violations.  His adjudged sentence was a 1,500,000 Won fine.

In Uijeongbu District Court on 6 January 2015, SGT Jeremy M. Cox, E Btry 6/52d ADA, USAG Casey, was convicted of DUI.  His adjudged sentence was a 3,000,000 Won fine.

In Uijeongbu District Court on 6 January 2015, SPC Daniel S. Vega, LRC-RC, 403d AFSB, USAG Casey, was convicted of DUI.  His adjudged sentence was a 3,000,000 Won fine.

In Uijeongbu District Court on 12 January 2015, SGT Charles L. Kamuf, HHC, 1/73d Armor, USAG Casey, was convicted of Assault.  His adjudged sentence was a 500,000 Won fine.

In Jeonju District Court on 13 January 2015, A1C Emanuel A. Na, 8th LRS, Kunsan Air Base, was convicted of Indecent Act by Compulsion.  His adjudged sentence was a 2,000,000 Won and registration as a sex offender with the local authority.

In Uijeongbu District Court on 15 January 2015, SSG Jari A. Yarrell, I&S Co, HHB, 8th Army (duty w/G-6), was convicted of Larceny and DUI.  His adjudged sentence was a 4,500,000 Won fine.

In Daegu District Court on 15 January 2015, PVT Geoffrey B. Cothran, B Co, 30th ESB, USAG Humphreys, was convicted of DUI.  His adjudged sentence was a 3,000,000 Won fine.

In Seoul Western District Court on 21 January 2015, PFC Eric J. Bradley, F Co, 302d BSB, USAG Humphreys, was convicted of Infliction of Bodily Injury.  His adjudged sentence was a 1,000,000 Won fine.

In Seoul Central District Court on 22 January 2015, WO1 Scedric A. Moss, HHC, 65d Medical Brigade, USAG Yongsan, was convicted of traffic law violations.  His adjudged sentence was a 1,000,000 Won fine.

In Seoul Central District Court on 23 January 2015, SrA Weston P. Basinger, 113FW, attached to 8FW, Kunsan Air Base, was convicted of Indecent Act by Compulsion.  His adjudged sentence was a 2,000,000 Won fine, sexual violence treatment class for 40 hours and registration as a sex offender with the local authority.

In Suwon District Court on 23 January 2015, CW2 Quentin M. Hagewood, A Co, 3-2 GSAB, USAG Humphreys, was convicted of DUI.  His adjudged sentence was a 3,000,000 Won fine.

Mayberry, 501st Special Troops Battalion, 501st Sustainment Brigade, was found guilty of two Specifications of failure to obey a lawful general order (Article 92, UCMJ); one Specification of false official statement (Article 107); two Specifications of larceny of non-military property (Article 121); and two Specifications of stealing mail in (Article 134).  She was sentenced to be reduced to E-1, confined for 20 months, and to be discharged with a Bad-Conduct Discharge.

On 8 December 2014, at a General Court-Martial, SFC William J. Delgado, 65th Medical Brigade, was convicted of one specification of violating a lawful general order (Article 92, UCMJ) and one specification of sexual assault (Article 120).  He was sentenced to be reduced to E-1, to be confined for 36 months, and to be discharged with a Bad-Conduct Discharge.

On 10 December 2014, at a General Court-Martial, PV2 Deandre Coleman, 2d Infantry Battalion, 9th Infantry Regiment, 2d Infantry Division, was found guilty of two specifications of failure to go to his appointed placed of duty, (Article 86, UCMJ), one specification of disrespect to a commissioned officer (Article 89), one specification of failure to obey a lawful general order (Article 92), and three specifications of larceny (Article 121).  He was sentenced to be reduced to the grade of E-1, to be confined for eight months, and to be discharged with a Bad Conduct Discharge.

In Seoul Central District Court on 4 December 2014, CPT Sophie S. Hilaire, HHB, 8th Army, duty w/USFK, was convicted of traffic law violations.  Her adjudged sentence was a 2,000,000 Won fine.

In Suwon District Court on 10 December 2014, PVT Dmitri N. Davis, HHC, 3-2 GSAB, USAG Humphreys, was found not guilty of the charges of Indecent Act by Compulsion.

In Daegu District Court on 18 December 2014, PVT Travis D. Mitchell, 551st ICTC, USAG Daegu (Carroll), was convicted of Indecent Act by Compulsion.  His adjudged sentence was a 10,000,000 Won fine.

In Seoul Central District Court on 31 December 2014, Capt Jonathan P. Walsh, HQ, 7th Air Force (A7X), Osan Air Base, was convicted of Infliction of Bodily Injury, Destruction and Damage of Property and Violation of the Minor Offense Act.  His adjudged sentence was a 1,000,000 Won fine.

USFK Court Martial Result for September 2014

Below are the USFK Court Martial and ROK Criminal Prosecution Results for September 2014 that were posted on the USFK website.  Of interest in September was that a Captain refused to take the breathalyzer test and was convicted of this crime.  He received a 5,000,000 won fine which is steeper than the usual 3,000,000 won fine DUI convictions usually receive.  However, he doesn’t get a DUI conviction on his record.  Is that worth 2,000,000 won?  Probably if refusing the breathalyzer doesn’t get him kicked out of the Army. Then 1-38 FA had three soldiers get convicted of obstruction to include one soldier for also performing an indecent act and had to register as a sex offender.  I wonder what that soldier did to the KNPs to get that punishment?

Trial Results September 2014

Results of Army Courts-Martial for September 2014

On 3 September 2014, at a General Court Martial, SSG Vaughn K. Totten, 94th Military Police Battalion, 501st Sustainment Brigade, was convicted of one specification of failure to obey a lawful general regulation (Article 92, UCMJ).  He was sentenced to reduction to E-5.

On 4 September 2014, at a Special Courts-Martial, PV2 Kendrick Rhodes, 304th Expeditionary Signal Battalion, 1st Signal Brigade was found guilty of one specification of larceny of property of less than $500 in value (Article 121, UCMJ), and of three specifications of writing checks with insufficient funds (Article 123a, UCMJ).  The Soldier was sentenced to reduction to E-1, forfeiture of $450 per month for two months, and to perform hard labor without confinement for two months.

On 7 September 2014, at a General Court Martial, PFC Hakim A. Blackwell, 304th Expeditionary Signal Battalion, 1st Signal Brigade was found guilty of three specifications of assault consummated by a battery (Article 128, UCMJ).  He was sentenced to reduction to E-1, to be confined for 4 months, and a Bad Conduct Discharge.

On 17 September 2014, at a Special Court Martial, PFC Kameron M. Coleman, 23d CBRNE Battalion, 1st Armored Brigade Combat Team, 2d Infantry Division, was found guilty of two specifications of sexual assault (Article 120, UCMJ).  He was sentenced to reduction to E-1, forfeiture of all pay and allowances, confinement for 12 months, and a Bad Conduct Discharge.

In Seoul Central District Court on 3 September 2014, CPT Windel P. Pegott, HSC, HHB, 8th Army, was convicted of Refused to Take the Breath Test in violation of the Road Traffic Act.  His adjudged sentence was a 5,000,000 Won fine.

In Suwon District Court on 12 September 2014, SSgt Joseph D. Lansangan, 51st AMXS, Osan Air Base, was convicted of DUI.  His adjudged sentence was a 1,000,000 Won fine.

In Bucheon Branch of the Incheon District Court on 16 September 2014, SPC Dong Hwan Kim, HHB, 2-1st ADA, USAG Daegu (Carroll), was convicted of DUI.  His adjudged sentence was suspended imposition of a sentence.

In Suwon District Court on 17 September 2014, SPC Nicholas P. Myers, B Btry, 1/38th FA, USAG Casey, was convicted of Indecent Act by Compulsion and Obstruction of Performance of Official Duties.  His adjudged sentence was imprisonment for 10 months, suspended for 2 years.  He was also ordered to register as a sex offender.

In Uijeongbu District Court on 23 September 2014, SSG Jari A. Yarrell, EUSA NCO Academy, USAG Red Cloud, was convicted of the crimes including Infliction of Bodily Injury, Unlawful Use of an Automobile and DUI.  His adjudged sentence was a 5,000,000 Won fine.

In Uijeongbu District Court on 29 September 2014, PVT Joon Suk Yoon, HHC, 2/9th Infantry, USAG Casey, withdrew his prior request for formal trial and accepted the summary order of 11 April 2014 finding him guilty of larceny and sentencing him to a 2,000,000 Won fine.

 

USFK Court Martial Results for August 2014

Below are the USFK court martial and ROK criminal prosection results for August 2014 that were posted on the USFK website.  The court martial results have a number of sex offender cases with a couple of people actually found not guilty of the crimes.  Then in the ROK criminal prosecution there is a major that was convicted of an indecent at and has to take sex offender classes and register as a sex offender.  He looks like a candidate now for officer cuts, but I wonder if the sex offender label in Korea follows him to the US as well?  That would be worse punishment than being discharged from the Army in my opinion.

Results of Army Courts-Martial for August 2014

On 1 August 2014, at a Summary Court-Martial, SPC Kristopher Hester (1st Armored Brigade Combat Team, 2d Infantry Division) was found not guilty of two specifications of Article 120, Abusive Sexual Contact, and found guilty of Article 128, Simple Assault.  He was sentenced to reduction to the grade of Private (E-1) and forfeiture of $1021.

On 4 August 2014, at a Special Court-Martial, SFC Vincent Irvin (1st Armored Brigade Combat Team, 2d Infantry Division) was found guilty of one specification of Article 128, Assault Consummated by Battery.  SFC Irvin was sentenced to reduction to E-4, forfeiture of $1000.00 pay per month for 4 months, and to be confined for four months.

On 8 August 2014, PV2 Devin L. Goetsch (19th Personnel Company, 501st Special Troop Battalion) was convicted at a Special Court-Martial of one specification of failure to obey a lawful general order (Article 92, UCMJ); and two specifications of wrongful possession of controlled substance ( Article 112).  He was sentenced to reduction to Private (E-1); forfeiture of $800.00 pay for five months; to be confinement for five months; and to receive a Bad Conduct Discharge.

On 11 August 2014, at a Summary Court-Martial, a Specialist from 1st Armored Brigade Combat Team, 2d Infantry Division was found not guilty of one specification of Article 120, Abusive Sexual Contact.

On 26 August 2014, PFC Kenneth A. Elmore (595th Maintenance Company, 498th Combat Sustainment Support Battalion) was convicted at a General Court-Martial of one specification of failure to obey a lawful order (Article 92, UCMJ); and one specification of Sexual Assault (Article 120).  He was sentenced to reduction to Private (E-1), confinement for 14 months; and to receive a Bad Conduct Discharge.

In Daegu District Court on 8 August 2014, SPC Matthew D. Wright, 188th MP Company, USAG Daegu, was convicted of Assault with a dangerous Instrument and Hit and Run.  He was acquitted of the charges of DUI and Infliction of Bodily Injury.  His adjudged sentence was imprisonment for 1-1/2 years, suspended for 2 years.

In Uijeongbu District Court on 13 August 2014, SGT George Watts, 55th MP Company, USAG Casey, was convicted of Assault with a Dangerous Instrument, Assault and Infliction of Bodily Injury.  His adjudged sentence was imprisonment for 1-1/2 years, suspended for 3 years.

In Uijeongbu District Court on 13 August 2014, SPC Donnell T. Francis, E Btry, 2-1st ADA, USAG Daegu (Carroll), was convicted of Infliction of Bodily Injury.  His adjudged sentence was imprisonment for 6 months, suspended for 1 year.

In Uijeongbu District Court on 19 August 2014, SGT Ricky W. Hoerlein, D Co, 4/7th Cavalry, USAG Casey, was convicted of traffic law violations including DUI.  His adjudged sentence was a 3,000,000 Won fine.

In Suwon District Court on 19 August 2014, PVT Terrance T. Tolbert, D Co, 3-2 GSAB, USAG Humphreys, was convicted of Assault.  His adjudged sentence was a 1,000,000 Won fine.

In Seoul Central District Court on 20 August 2014, MAJ Mario R. Mesa, HHB, 8th Army (I&S Co), was convicted of Indecent Act by Compulsion.  His adjudged sentence was imprisonment for 8 months, suspended for 2 years.  He was also ordered to enroll in a sexual crimes prevention class for 40 hours and register as a sex offender with the local authority.

In Seoul Central District Court on 20 August 2014, SSG Marcus C. Polarchy, HHB, 8th Army (HSC), USAG Yongsan, was convicted of Infliction of Bodily Injury.  His adjudged sentence was a 3,000,000 Won fine.

In Seoul Central District Court on 20 August 2014, Airman Federico F. Garza, 51st Munitions Squadron, Osan Air Base, was convicted of Larceny.  His adjudged sentence was a 2,000,000 Won fine.

In Uijeongbu District Court on 20 August 2014, SFC Timothy M. Caruana, HHC, 1/72d Armor, USAG Casey, was convicted of traffic law violations.  His adjudged sentence was a 2,000,000 Won fine.

In Daegu District Court on 20 August 2014, MSG Wilbert Cassidy, Jr., HHC, 501st S-Brigade, USAG Daegu (Carroll), was convicted of traffic law violations.  His adjudged sentence was a 1,000,000 Won fine.

In Suwon District Court on 25 June 2014, SFC Jeremy L. Johnson, D Co, 2-2 Assault, USAG Yongsan, was convicted of DUI and Hit and Run.  The Soldier requested a formal trial, but on 25 August 2014, he withdrew the request.  His adjudged sentence was a 7,000,000 Won fine.

In Uijeongbu District Court on 27 August 2014, SPC Joshua G. Wade, 629th MCAS, USAG Casey, was convicted of Damage of Property and Infliction of Bodily Injury.  His adjudged sentence was a 3,000,000 Won fine.

In Daegu District Court on 27 August 2014, SGT Michael A. David, HHD, 25th Transportation Battalion, USAG Daegu, was convicted of DUI and Infliction of Bodily Injury through Dangerous Driving.  His adjudged sentence was a 5,000,000 Won fine.

In Daejeon District Court on 28 August 2014, SrA Juan C. Azenon-Baries, 51st LRS, Osan Air Base, was found not guilty of Quasi-Robbery, but guilty of Larceny.  His adjudged sentence was a 2,000,000 Won fine.

At a special court-martial on 5 November 2008, Specialist Charles A. Rivera, Echo Company, 1-2 Aviation Regiment, 2d Combat Aviation Brigade, Second Infantry Division, was convicted of four specifications of assault consummated by battery, being drunk and disorderly, and failing to obey a lawful general order.  He was sentenced to reduction to Private First Class (E-3) and forfeiture of $843.00 for two months.

At a special court-martial on 13 November 2008, Private Shavonte Hampton, C Company, 302d Brigade Support Battalion, 1st Heavy Brigade Combat Team, Second Infantry Division, was convicted of making a false official statement and failing to go to her appointed place of duty.  She was sentenced to confinement for six (6) months, and forfeiture of $898.00 pay per month for six (6) months.
